OVERVIEW

Welcome to FlipDexTCG! FlipDexTCG operates this store and website, including all related information, content, features, tools, products and services to provide you, the customer, with a curated shopping experience (the “Services”). FlipDexTCG is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.

Consumer rights: Nothing in these Terms limits any non-waivable rights you may have under Maltese or EU consumer law, including the 14-day withdrawal right for online sales where applicable.

SECTION 1 — ACCESS, ELIGIBILITY & ACCOUNT

  1. Age / eligibility. You confirm you are at least the age of majority in your country of residence (18 in Malta). If you allow a minor to use the Services on a device you control, you remain responsible for their activity.

  2. Account information. You may be required to provide information such as your email address, billing, payment, and shipping details. You represent that all information you provide is accurate, current, complete, and that you have the rights needed to provide it.

  3. Security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 — PRODUCTS, COLLECTIBLES & CONDITION (VERY IMPORTANT)

  1. Collectible nature; subjectivity. Trading cards and collectibles are inherently subjective in condition and value. You agree that condition assessment is not an exact science.

  2. Listings control. The product listing (title, set, language, version/printing, stated condition, notes, and photos/scans) forms the definitive description of the item you are purchasing. If the item delivered matches the listing, it is considered supplied as agreed.

  3. Vintage / binder expectation; grading disclaimer. Where a listing indicates wear (e.g., LP/MP/HP/Damaged or notes/photos showing whitening, scratches, dents, creases, print lines, etc.), you acknowledge such items may be unsuitable for professional grading and may be best suited for collection, binder/master set completion, or display.
    “I hoped it would grade higher” is not a valid reason for a claim where the listing disclosed or showed the relevant characteristics.

  4. Colour / appearance variation. Colours and appearance may differ depending on your screen/device and settings. Minor print/finish variation may occur across sets/eras/print runs.

We reserve the right to update product descriptions, discontinue products, and limit quantities at our discretion, subject to applicable law.

SECTION 3 — ORDERS & CONTRACT FORMATION

  1. Offer and acceptance. When you place an order, you are making an offer to purchase. We may accept or decline orders at our discretion (e.g., suspected fraud, stock errors, pricing errors, repeated abusive disputes), subject to applicable law. The contract forms when we confirm acceptance and/or dispatch your order.

  2. Cancellations. Please review your order carefully before submitting. We may not be able to accommodate cancellation requests once an order is accepted or dispatched.

  3. Returns. All returns, refunds, and withdrawal requests are governed by our Returns & Refunds Policy [LINK], and by any mandatory legal rights applicable to you.

  4. Resale. Unless expressly agreed in writing, purchases are for personal use and not for commercial resale/export.

SECTION 4 — PRICES, BILLING & PAYMENTS

  1. Pricing. Prices, discounts, and promotions may change without notice. The price charged is the price shown at checkout at the time you place your order.

  2. Taxes and shipping. Unless stated otherwise, prices typically exclude shipping and may exclude or include VAT depending on how your store is configured and where goods are shipped.

  3. Billing accuracy. You agree to provide current, complete, and accurate purchase and account information, and to promptly update it so we can complete transactions and contact you if needed.

  4. Payment authorization. You represent you are authorized to use the chosen payment method and that charges will be honoured by your payment provider.

SECTION 5 — SHIPPING & DELIVERY

  1. Delivery times are estimates. All delivery times are estimates and not guaranteed. Delays may occur due to carriers, customs, peak periods, or events outside our control.

  2. Risk and title. For consumer orders, risk passes to you on delivery as required by applicable law. For non-consumer/B2B transactions, risk may pass upon handover to the carrier unless the law requires otherwise.

  3. Address accuracy. You are responsible for ensuring your shipping address is accurate and complete. Additional shipping costs caused by incorrect addresses or failed delivery attempts may be charged to you where permitted by law.

  4. Customs / import charges. For shipments outside your country, customs duties, import taxes, and fees may apply and are your responsibility unless stated otherwise.

SECTION 6 — INTELLECTUAL PROPERTY

  1. Ownership. Our Services (including trademarks, branding, text, graphics, images, videos, audio, and the design/arrangement thereof) are owned by FlipDexTCG and/or our licensors and are protected by applicable intellectual property laws.

  2. Limited license. You may use the Services for your personal, non-commercial use only. You must not copy, reproduce, distribute, modify, create derivative works, republish, scrape, or exploit any part of the Services without our prior written consent.

  3. Trademarks. FlipDexTCG names, logos, and branding are trademarks of FlipDexTCG or licensors. Shopify marks belong to Shopify. All other marks belong to their respective owners.

We may provide access to third-party tools that we do not control. You acknowledge we provide access “as is” and “as available” without warranties, and we are not liable for your use of third-party tools.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

FlipDexTCG is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with FlipDexTCG. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and FlipDexTCG, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with FlipDexTCG.

SECTION 10 — PRIVACY

Your use of the Services is subject to our Privacy Policy [LINK]. Because the Services are hosted by Shopify, Shopify may also process personal data to provide and improve the Services.

SECTION 11 — FEEDBACK & REVIEWS

If you submit reviews, comments, ideas, suggestions, or other content (“Feedback”), you grant us a worldwide, perpetual, royalty-free licence to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for operating and promoting the Services. You confirm you have the necessary rights to submit Feedback and that it does not violate third-party rights or laws.

We may remove Feedback we consider unlawful, misleading, abusive, or otherwise inappropriate.

We may correct errors (including pricing errors) and update information at any time without prior notice. If an error affects your order, we may cancel or adjust it and will attempt to notify you using the details provided.

  • violate any applicable law or regulation;

  • infringe intellectual property rights;

  • harass, abuse, defame, threaten, or discriminate;

  • submit false or misleading information;

  • attempt unauthorized access, interfere with security, or introduce malware;

  • scrape, crawl, or use bots to extract data without permission;

  • engage in conduct that harms FlipDexTCG, Shopify, or users.

We may suspend or terminate access if we reasonably believe you have violated these Terms.

We may terminate or suspend access to the Services at any time, with or without notice, to the extent permitted by law. You remain liable for all amounts due up to the termination date.

To the fullest extent permitted by law, FlipDexTCG (and our officers, employees, agents, contractors, service providers, and licensors) and Shopify (and its affiliates) will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost revenue, loss of data, or replacement costs arising from or related to your use of the Services or products.

Nothing in these Terms excludes or limits liability where it cannot be excluded under law (including fraud, or other non-waivable consumer protections).

SECTION 17 — INDEMNIFICATION

You agree to indemnify and hold harmless FlipDexTCG, Shopify, and their affiliates, officers, directors, employees, agents, licensors, and service providers from claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.

SECTION 18 — SEVERABILITY

If any provision is held unlawful or unenforceable, the remaining provisions remain in effect.

SECTION 19 — WAIVER; ENTIRE AGREEMENT

SECTION 21 — GOVERNING LAW & JURISDICTION

These Terms and any dispute arising from them or your use of the Services will be governed by the laws of Malta, and the courts of Malta will have jurisdiction, subject to any mandatory consumer protection rules that apply to you.
